Calcular Finiquito por Despido

El término finiquito laboral por despido, es conocido por ser la indemnización otorgada al trabajador despedido de una empresa, si aplica a este. Además es obligación de la empresa, dar entrega al trabajador un documento donde se establezcan detalladamente las causas de despido, así como la cantidad de su indemnización.

¿Cómo calcular el finiquito por Despido?

Dicho documento será firmado por el ex empleado al estar de acuerdo con el cálculo de su indemnización. En caso de no estar de acuerdo, puede optar por no firmar el documento, o firmar con una nota de no estar de acuerdo.

Sin embargo, al decidir no firmar el documento, esté dejará de prescindir de la indemnización y no la recibirá. La cantidad recibida será parte de las vacaciones no disfrutadas y la parte proporcional de las pagas extraordinarias.

En este caso extremo, existe la opción de exigir la cantidad considerada correcta en las oficinas del SMAC. Para esto se realizará un acto de conciliación en donde deberán participar ambas partes, y en caso de estar conforme, no será necesario un juicio.

¿Qué incluye el finiquito o indemnización por despido?

En el documento del finiquito deberá ir establecidas las remuneraciones recibidas y no recibidas por el trabajador. Y si corresponde, una indemnización.

  • Salario pendiente de los días trabajados.

  • Pagas extraordinarias.

  • Vacaciones no disfrutadas.

  • Cualquier otro pago pendiente, como bonos, horas extras, entre otros.

En caso de finiquito por despido, el trabajador tiene derecho a una indemnización. Si el despido ocurrió debido a causas objetivas, deberá calcularse en base a 20 días de salario por año trabajado teniendo un máximo de 12 mensualidades. En caso contrario de que el causal de despido sea improcedente, será de 33 días por años trabajados, con un máximo de 24 mensualidades.

Es importante tener en cuenta que ambos términos son complementarios pero no iguales, debido a ello, el trabajador debe recibir ambos el finiquito y la indemnización por separado.

¿Cómo calcular finiquito laboral por despido?

El cálculo del finiquito viene estructurado por tres conceptos fundamentales:

Los días de vacaciones.

Anualmente, un empleado dispone de unos días de vacaciones de los cuales puede disponer o no dependiendo de su decisión. En caso de que el despido ocurra antes de que el trabajador disfrute de sus vacaciones, pueden ocurrir ciertos escenarios.

El trabajador tendrá derecho a prescindir del pago correspondiente de esos días no disfrutados.

La empresa preferirá que el trabajador desempeñe su puesto hasta el último día, y que disfrute de sus vacaciones con su paga correspondiente.

Si el trabajador ya ha consumido y disfrutado sus días de vacaciones y luego de esto ocurre el despido, la empresa al momento de calcular el finiquito, descontará del monto total de los días correspondientes de las vacaciones.

El salario del mes actual.

Los días laborados del mes en que sucedió el despido, deberán ser remunerados en el finiquito si estos aún no han sido cancelados.

Pagas extraordinarias.

Cualquier pago extra que no haya sido remunerado a la fecha del despido, deberá ser añadido igualmente al finiquito.

Ejemplo práctico del cálculo del finiquito.

Salario: 15000 pesos al mes.

Vacaciones caídas: 12 días.

Pagos extras: 4500 pesos al mes.

Culminación del contrato: 10 de octubre.

Calculamos cuál es el pago diario recibido por el empleado: 15000 pesos / 30(días) = 500 pesos.

Luego, se multiplica la cifra del salario diario, por los días trabajados del mes actual: 500 pesos x 10(días) = 5000 pesos.

Por otro lado, cada día de vacaciones equivale a un día de salario laboral, por lo tanto si el trabajador contaba con 10 días de vacaciones, sería: 500 pesos x 12(días de vacaciones) = 6000 pesos.

Finalmente, el pago extra recibido mensualmente se divide entre los días del mes para dar el resultado del pago extra diario: 2500 pesos / 30(días) = 83,3 pesos x 10 (días de trabajo) = 833,3 pesos.

Una vez obtenidos todos los datos, se procede a sumar los términos: 500 pesos + 5000 pesos + 6000 pesos + 833,3 pesos = 12.333,3 pesos.

Finalizando así que el monto del finiquito por despido total sería: 12.333,3 pesos.
